Land advertised as “residential” may be a registered building plot, a field within a residential zone or part of a proposed subdivision. The distinction can affect the cost of the purchase and how soon, if at all, the buyer can build.
The title investigation establishes ownership and any burdens affecting the land. Whether the proposed house can be built requires planning advice as well. This article concerns land in the areas controlled by the Republic of Cyprus.
What is being sold
In Cyprus, “plot” is often used in advertisements without much precision. The title, cadastral plan and planning records provide a better account of what the seller owns.
A field can have its own title and fall within a residential zone without being a registered building plot. Depending on the proposed works, development may involve road provision, services or division requirements. This does not mean that every field must first be converted into a plot before any building is possible.
The position is different where a buyer is purchasing a future plot from a larger subdivision. There may already be an approved layout, but roads or other works may remain unfinished. Separate registration follows the relevant approvals and completion requirements; the drawing alone does not establish a separate plot in the Land Registry.
In that transaction, the contract needs to allocate the outstanding work and its cost. It also needs a timetable and a remedy if the seller fails to complete. Otherwise, a purchaser may have paid for a plot while still depending on the seller to finish the wider scheme.
Assessing the proposed development
A building-density percentage gives only part of the picture. Permitted use, coverage, height and distances from boundaries affect the design, as do the shape and frontage of the parcel. Land can also fall within more than one planning zone.
An architect familiar with the area can assess the proposed building against the applicable Local Plan, Area Scheme or Policy Statement. For a small development, this work may reveal that the number of units assumed in the asking price is unrealistic.
The Department of Lands and Surveys’ online maps help identify the parcel and its planning zone. A map entry is not permission for a particular project. The owner or an authorised representative can seek formal preliminary views from the competent Planning Authority on a proposed development.
Road widening proposals, watercourses and protected or archaeological areas can affect the design or require further approvals. An existing permit also deserves a reading in full: its approved plans, conditions and validity matter as much as the fact that it was issued. The necessary planning and building authorisations must be in place before works begin, subject to the applicable exemptions.
Can agricultural land be used for a house
The presence of houses in neighbouring fields is often offered as reassurance. It proves little about a new application. Those houses may have been permitted under earlier policies or on circumstances which do not apply to the land for sale.
Residential development outside the development boundary is governed by the applicable planning policy. A low building-density figure for an agricultural zone does not give every owner a right to erect a dwelling. The area of the field is not decisive either.
If the purchase is intended for a home, the architect’s advice needs to address that use expressly. A general statement that “some development is allowed” leaves too much unanswered. Where approval remains uncertain, the buyer may need a conditional agreement rather than an immediate commitment to complete.
A seller may genuinely expect the residential boundary to expand, but that expectation is not an existing entitlement and cannot be relied on when applying for permission today.
The road shown on the plan
There may be a track across a neighbour’s field, or an informal arrangement which has worked for years. Neither necessarily supplies the legal access needed by the buyer.
The route, width and legal basis of access need to be established. An existing right of way must be read with its terms and considered against the proposed use. Access sufficient for agricultural purposes may not satisfy the requirements for housing. Rights enjoyed by neighbours over the land being bought can also restrict where a building is placed.
Section 11A of the Immovable Property (Tenure, Registration and Valuation) Law, Cap. 224, allows an owner of landlocked property, or property with insufficient access, to claim necessary passage over neighbouring land against reasonable compensation. The statutory procedure determines matters which the parties may not agree, including the route and compensation. A purchaser cannot assume that a preferred route will be obtained quickly or at a particular cost.
Obtaining a right of way does not itself establish that the Planning Authority will approve the intended development.
Buying half a plot
A “half plot” may mean a separately registered parcel. It may instead mean a one-half undivided share in a larger property. With an undivided share, the registered ownership extends to a proportion of the whole, rather than exclusively to the half marked out on site.
A distribution agreement may allocate possession and use of specified parts between the co-owners. It does not, of itself, create separate titles or authorise construction.
A contract for a defined part of jointly owned land raises an additional requirement. If that part has no separate registration and not all owners are selling, deposit of the contract requires a distribution agreement signed by all registered owners, with certified signatures. The agreement must allocate the part being sold to at least one of the sellers with the right to possess, use and dispose of it freely.
A sale of an undivided share to an outsider may also engage the other registered co-owners’ statutory right to acquire it at the sale price, subject to the exceptions in Cap. 224.
Boundaries and services
A site visit can reveal matters absent from the seller’s description. Fencing may not follow the cadastral boundary, part of the parcel may be occupied by a neighbour, or the advertised entrance may cross someone else’s land. Survey evidence and, where necessary, the Land Registry’s boundary procedures help resolve discrepancies. A private survey cannot conclusively settle a contested legal boundary.
For sloping or difficult ground, an engineer’s assessment may alter the construction budget considerably. Retaining works and drainage are easily overlooked when the buyer is concentrating on the price per square metre.
The presence of electricity poles or a water main nearby does not establish the terms or cost of connection. Service providers can confirm what is available. Pipes or cables crossing adjoining land may require rights which the seller has never obtained.
Before paying a deposit
A reservation agreement may already bind the buyer. Its wording needs to reflect any outstanding condition, whether that is satisfactory planning advice, finance or completion of subdivision works. The agreement should also identify who holds the deposit and when it is returned or released.
The title investigation covers the registered owner, mortgages, memos, earlier deposited contracts and relevant prohibitions. A mortgaged parcel requires a workable release arrangement with the lender. Payment to the seller does not, on its own, remove the mortgage.
Under the rules introduced on 12 December 2023, the seller must attach the prescribed search certificate to the sale contract as an integral part. Its date must not differ from the signing date by more than five working days. The ordinary deadline for depositing a qualifying sale contract at the District Lands Office is six months from signature, subject to statutory exceptions. Deposit protects contractual rights but does not transfer title or resolve planning defects.
Where the parties are ready for an immediate transfer of registered title and all requirements are met, a separate sale contract is not essential.
Permission to acquire land and VAT
Buyers who are neither EU nor EEA nationals generally require permission to acquire immovable property under Cap. 109, subject to the statutory exemptions. The Ministry of Interior’s published guidance describes the ordinary permission route for a plot or land up to 4,000 square metres for an owner-occupied dwelling. This is not a universal statutory ceiling for every type of acquisition. A buyer proposing a larger purchase or a commercial project needs advice on the permission available for that acquisition. Certain foreign-controlled companies also fall within the legislation; incorporation in Cyprus does not automatically avoid it.
A sale of undeveloped building land by a person carrying on an economic activity can attract VAT. Calling the property a “field” does not decide its tax treatment. The price must be clear on whether VAT is included, with transfer fees considered where applicable.
How we can help
A.Danos & Associates LLC acts for purchasers of building plots, agricultural land and development sites in Cyprus. We carry out title investigations, advise on access and co-ownership, and negotiate the purchase documents. Where construction is proposed, we coordinate the legal work with the purchaser’s technical advisers before the transaction proceeds.
